TERMS and CONDITIONS
Our images are provided under the following licence. It defines what you may do with our images (hereinafter referred to as the "Images") and it contains limitations on warranties and/or remedies. All Images are and will remain the exclusive property of Penrith Web Publishing.

BY PURCHASING A LICENCE FOR ONE OR MORE OF OUR IMAGES, YOU ARE AGREEING TO BIND YOURSELF AND/OR YOUR COMPANY TO THE TERMS OF THIS AGREEMENT. A LICENCE TO USE OUR IMAGES WILL ONLY BE GRANTED ON THE CONDITION THAT YOU AND/OR YOUR COMPANY AGREE TO THE TERMS OF THIS AGREEMENT. ORDERING ONE OR MORE OF OUR IMAGES WILL BE AN IRREVOCABLE ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND PENRITH WEB PUBLISHING. PLEASE READ THIS AGREEMENT IN ITS ENTIRETY BEFORE PURCHASING AN IMAGE LICENCE. 

GRANT OF LICENCE
On payment for the licence, Penrith Web Publishing grants you a personal, nontransferable, nonexclusive right to copy the Image you have selected onto your computer hard drive. The Image may also be transferred to one internet or intranet web server for the sole purpose of displaying the image in a panoramic viewer. This licence is valid only with respect to the Image and only if you have paid the applicable licence fee. The Image may be copied, for PERSONAL, TEST or BACKUP use and may not be sold or sublicensed alone or as part of any for-sale product. Pornographic, defamatory, libelous or otherwise unlawful use of the Image is prohibited.

ADDITIONAL RIGHTS

WARRANTIES 
Penrith Web Publishing warrants the digital copy of the Image to be free from defects in material and workmanship for 90 days from delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the digital copy of the Image or a refund of the licence purchase price.

PENRITH WEB PUBLISHING MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TYPE OR QUALITY OF IMAGE OR COMPATIBILITY WITH ANY COMPUTER OR OTHER KIND OF EQUIPMENT. NEITHER PENRITH WEB PUBLISHING NOR ITS MANAGEMENT SHALL BE LIABLE TO YOU FOR ANY GENERAL, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR OTHER DAMAGES ARISING OUT OF THE LICENCE OF THE IMAGE.

GENERAL
All rights to the Image are owned by Penrith Web Publishing, and are protected by Australian copyright laws, international treaty provisions and other applicable laws.
Penrith Web Publishing retains all rights not expressly granted by this agreement. The Image is licensed only to you and may not be transferred or sublicensed without the prior written consent of Penrith Web Publishing. The licence contained in this agreement will terminate automatically without notice from Penrith Web Publishing if you fail to comply with any provision of this agreement.

Upon termination, you must immediately (i) stop using the Image and (ii) delete the Image and all copies from all magnetic media and destroy all other copies of the Image. Your use of the Image must be in compliance with all applicable laws, including but not limited to laws and regulations relating to currency and the law of moral rights. You agree to indemnify and hold Penrith Web Publishing harmless from and against all material liabilities, claims, expenses and damages, including, without limitation, reasonable legal fees, arising from any suit, claim or proceeding related to your use of the Image other than permitted by this agreement.
